1. Acceptance of Terms

By accessing or using the services provided by Synerdyn SAS (project), you agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services or website.

2. Nature of Services

Synerdyn SAS (project) provides professional services in the field of cybersecurity, including but not limited to:

  • Security Audit

  • Strategic Consulting

  • Penetration Testing

  • Data Encryption

  • OSINT (Open Source Intelligence)

  • Training & Awareness

  • Managed Security Services

  • Digital Forensics

  • IoT Security

  • Protection Against Malwares & Ransomwares

  • Identity & Access Management

  • Threat Monitoring & Detection

  • Security Incidents Management

  • Technical and strategic cybersecurity support

The company commits to performing these services with diligence and in accordance with industry standards.

3. No Guarantee of Results

The services offered by Synerdyn SAS (project) are obligations of means (“obligation de moyens”) and not obligations of results (“obligation de résultat”).

Synerdyn SAS (project) shall undertake reasonable efforts to identify vulnerabilities, provide recommendations, and support mitigation strategies, but cannot guarantee complete protection against cyber threats or the elimination of all risks.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Synerdyn SAS (project) disclaims all liability for:

  • Any direct, indirect, incidental, consequential, or special damages

  • Loss of profits, income, business opportunities, or contracts

  • Data loss, corruption, or theft

  • Financial losses or reputational damage

  • Any loss or damages caused by cyberattacks, data breaches, malware infections, ransomware, denial-of-service attacks, unauthorized access, insider threats, or any other cyber incidents

Synerdyn SAS (project) shall not be held liable in the following situations:

  • Failure of third-party systems, software, or infrastructure

  • Force majeure (natural disasters, war, political events, etc.)

  • Misuse or misconfiguration by the client or third parties

  • Failure by the client to implement recommended security measures

  • Events caused by external actors outside the control of Synerdyn SAS (project)

Clients agree that they are solely responsible for decisions made based on the company's advice, and for the protection of their own data, systems, and digital infrastructure.

5. Indemnification

Clients agree to indemnify and hold harmless Synerdyn SAS (project), its employees, directors, and subcontractors against any and all claims, damages, or losses resulting from the use of its services, except in cases of proven gross negligence or intentional misconduct.

6. Jurisdiction and Applicable Law

These Terms are governed by the laws of France. Any dispute arising out of or in connection with these Terms or the services provided shall be submitted to the exclusive jurisdiction of the competent courts in Lyon, France.

For international clients (including those in Switzerland), the client expressly agrees to the applicability of French law and the jurisdiction of French courts.

7. Intellectual Property

All deliverables, reports, tools, software, or documentation provided by Synerdyn SAS (project) remain the intellectual property of the company, unless otherwise agreed in writing. Reproduction or distribution without prior consent is prohibited.

8. Confidentiality

All information exchanged between the client and Synerdyn SAS (project) is considered confidential and shall not be disclosed to third parties without written consent, except where required by law or judicial authority.

9. Changes to the Terms

Synerdyn SAS (project) reserves the right to modify these Terms at any time. Clients will be notified of significant changes and continued use of services constitutes acceptance of the updated Terms.

10. Company Status

Synerdyn SAS (project) is currently in formation and not yet fully registered. These Terms are provided as part of a pre-operational phase and are subject to updates upon formal registration of the company with French authorities.
